A Kahawa Law Court in Nairobi has convicted Ibrahim Hussein Hassan on multiple counts related to terrorism, including membership in the banned Al-Shabaab group and possession of extremist propaganda.
Principal Magistrate Gideon Kiage found Hassan guilty on seven charges under the Prevention of Terrorism Act, 2012. These included being part of a terrorist organization, gathering information connected with terrorism, and holding materials intended for terrorist acts.
Hassan was arrested on September 6, 2022, in Eastleigh Section III, Nairobi. Evidence presented showed he was affiliated with Al-Shabaab, which Kenya outlawed in 2015 through an official government notice.
The court's decision heavily relied on forensic analysis of Hassan's Samsung mobile phone. The device contained three videos featuring radical extremist propaganda designed to recruit, train, and radicalize youths into terrorism.
Magistrate Kiage stated, "In the absence of any reasonable explanation for possessing such content, the court infers the accused's association with a terrorist group."
The prosecution, led by Principal Prosecution Counsel Kennedy Amwayi and assisted by Fatuma Ahmed, called ten witnesses during the trial to establish the charges beyond reasonable doubt.
Following the conviction, the court scheduled a mitigation hearing for July 29, 2026, before sentencing.
