DARI Limited, a company linked to former Jubilee Party Secretary General Raphael Tuju, has confirmed compliance with a High Court order by depositing more than KSh 50 million to halt the auction of the Entim Sidai Wellness Sanctuary in Karen.
Despite this, Garam Investments Auctioneers published a notice announcing the auction of the 20-acre luxury property scheduled for August 25, raising questions about the auction's legality amid ongoing court proceedings.
Legal Compliance and Court Orders
- On June 9, 2026, legal representatives for DARI Limited submitted a letter to the High Court's Commercial and Tax Division confirming a deposit of KSh 52.57 million as security, exceeding the KSh 50 million required by Justice Moses Ado.
- The funds were placed in a joint interest-earning account at NCBA Bank, managed by lawyers representing both plaintiffs and defendants, ensuring transparency.
- The deposit originated from a prior security held since 2020, which became available following a Court of Appeal judgment in April 2023.
Background of the Dispute
The dispute dates back to a 2015 loan from the East African Development Bank to DARI Limited for property development. Following loan repayment issues, the conflict escalated into prolonged litigation in Kenyan and British courts, increasing the financial claims against DARI.
Earlier rulings include Justice Ado's refusal to halt the sale of another Tuju-linked property, Dari Business Park, due to completed ownership transfer. However, in the Entim Sidai case, the auction was temporarily suspended pending the security deposit.
Current Developments
Despite DARI Limited meeting court conditions, the auction notice has been published, prompting further legal scrutiny. The matter remains under active consideration in the High Court as stakeholders await resolution.
