The High Court has issued an interim order preventing the Law Society of Kenya (LSK) from interrupting court sessions involving certain judges and judicial officers. This directive will remain effective until September 17, 2026.
Justice David Mburu delivered the ruling on August 3, citing the need to maintain order within the Judiciary and to ensure uninterrupted administration of justice while a preliminary objection on court jurisdiction is being considered.
The order specifically restrains the LSK from disrupting proceedings before Chief Justice Martha Koome, Deputy Chief Justice Philomena Mwilu, and other judges named in the society's boycott communication, as well as any other judicial officers.
The petition prompting this ruling was filed by lawyer Adrian Kamotho, who challenged the LSK's nationwide boycott as unconstitutional and harmful to litigants' right to access justice. Other legal representatives, including those for the judges involved, opposed the boycott, arguing it undermines the justice system.
The matter remains pending, with the court set to hear the jurisdictional challenge in due course.
