The High Court in Kiambu has ordered the release of Mukurwe-ini Member of Parliament John Philip Gichohi Kaguchia on a cash bail of Sh100,000. This follows his arrest related to comments he made during a political rally in Nyeri County.
Lady Justice Njoki Mwangi issued the interim orders on Monday, acknowledging the urgency of Kaguchia's application. The court directed that he be freed from police custody upon payment of the bail, pending further hearing of the case.
The MP was also instructed to serve his application on the Inspector General of Police and the Director of Public Prosecutions, who have been given 14 days to respond. Kaguchia may file a supplementary affidavit within 14 days if necessary. The matter is scheduled for a virtual hearing on September 16, 2026.
Background of the Arrest
Kaguchia was taken into custody by officers from the Directorate of Criminal Investigations (DCI) on Monday morning, shortly after spending the night at Royal Media Services. He had stayed there amid reports that police had surrounded the premises.
The legislator indicated that the arrest stemmed from remarks he made during a rally in Kieni, Nyeri County, on Saturday. Investigators are examining whether his statements, allegedly warning Mt Kenya residents against supporting President William Ruto in the 2027 general election and threatening to trace voters' homes, constitute a criminal offense.
MP’s Response
Before his arrest, Kaguchia denied wrongdoing, asserting that his comments were taken out of context. He stated he had not received any formal summons and only learned about the investigation through social media.
He expressed willingness to cooperate with the National Cohesion and Integration Commission, which he said has jurisdiction over the matter. Kaguchia also accused government digital strategist Dennis Itumbi and some Mt Kenya lawmakers of circulating distorted versions of his remarks.
