A team of lawyers representing Mukurwe-ini MP John Philip Gichohi Kaguchia has apologised to the court after mistakenly removing him from the courtroom without an official release order.
On Tuesday, August 4, 2026, Senior Principal Magistrate Theresa Nyangena instructed Kaguchia to step out of the dock so she could attend to other matters. However, instead of waiting for the formal release, Kaguchia was hurriedly escorted out by his lawyers and colleagues, including Nyandarua Senator John Methu.
The magistrate had clarified that the MP was still in custody pending a ruling on whether the Directorate of Public Prosecutions could appeal, despite earlier High Court orders granting him freedom on personal bond. Nonetheless, Kaguchia left the courtroom and was seen boarding a vehicle with the senator.
When the court resumed at 3 pm for the ruling, Magistrate Nyangena found that Kaguchia was not present and ordered his immediate return, emphasizing that he had not been officially discharged and remained in custody.
Shortly after, Kaguchia was brought back under police escort. The magistrate released him on a Ksh1 million bond or Ksh500,000 cash bail, later reduced to Ksh250,000 following a defence request.
The lawyers admitted to misleading their client and apologised sincerely to the court for the confusion and premature removal. They assured the court that Kaguchia would appear for the next hearing scheduled on Wednesday, August 5, 2026.
