LSK Probes MPs Kaguchia and Kaluma Over Alleged Incitement

The Law Society of Kenya (LSK) has initiated a formal review of statements made by Mukurweini MP John Kaguchia and Homa Bay Town MP Peter Kaluma amid allegations of incitement.

LSK President Charles Kanjama announced that the Practice Standards and Ethics Committee, through its Ethics and Disciplinary Liaison Sub-Committee, will examine publicly available records of the MPs' remarks within 14 days. The aim is to establish whether these statements constitute professional misconduct.

Should the evidence warrant, the Society plans to file formal complaints against the two legislators before the Advocates Disciplinary Tribunal and to oversee the disciplinary proceedings until completion.

President Kanjama emphasized:

  • "Political office does not suspend professional obligations."
  • "Freedom of political expression does not extend to incitement to violence or hatred."
  • LSK will not tolerate members inflaming public tensions.

The Society also cautioned all advocates, including those active in politics, against making divisive, threatening, or inciteful statements, especially during electoral periods. Sanctions for violations may include suspension or removal from the Roll of Advocates.

This move follows recent events where Kaluma was summoned by the National Cohesion and Integration Commission (NCIC) over statements allegedly urging action against supporters of the "one-term" campaign targeting President William Ruto. Kaluma requested a postponement citing unavoidable State duties.

Separately, Kaguchia was arrested earlier in August after comments made at a Kieni rally warning Mt Kenya residents of consequences if they voted for President Ruto in 2027. He was released on a Ksh. 100,000 cash bail.
