Mukurwe-ini Member of Parliament John Kaguchia appeared before Milimani Senior Principal Magistrate Teresia Nyangena on Tuesday, pleading not guilty to charges of creating a disturbance likely to cause a breach of the peace.
The charge follows remarks allegedly made by Kaguchia during a talk show at Royal Media Studios in Kilimani, where he purportedly vowed to lead efforts to remove constituents supporting President William Ruto ahead of the 2027 general election.
Allegations and Defence Challenges
- The prosecution claims Kaguchia declared that Mukurwe-ini residents backing President Ruto would not receive support, referencing the impeachment of former Deputy President Rigathi Gachagua.
- It is further alleged that the MP suggested even ill supporters of the President should seek medical services in Sugoi, the President’s rural home.
- Kaguchia’s defence team contested the charges, arguing the case was filed in the wrong court since the alleged remarks were made in Nyeri County, outside Milimani court’s jurisdiction.
- Senior counsel Ndegwa Njiru highlighted that the case proceeded despite a High Court order mandating Kaguchia’s release on a Sh100,000 cash bail.
- The defence also challenged the validity of the charge sheet, pointing out that the translations relied upon were not certified by an official interpreter.
- Additionally, lawyers claimed police at Kamukunji station refused to accept the bail payment, detaining the MP overnight despite the court order.
