A Nairobi resident, Ibrahim Hussein Hassan, was convicted on seven terrorism-related charges at Kahawa Law Courts on July 28, 2026. The case was prosecuted by the Office of the Director of Public Prosecutions (ODPP), with sentencing scheduled for July 29.
Charges and Court Findings
Hassan faced allegations including membership in the banned terrorist group al-Shabaab, collecting information for terrorism purposes, and possession of materials linked to terrorist acts. Principal Magistrate Gideon Kiage ruled that the prosecution had proven its case beyond reasonable doubt.
Evidence showed that on September 6, 2022, Hassan was involved with al-Shabaab activities in Eastleigh Section III, Nairobi. The group has been outlawed in Kenya since April 7, 2015, under Gazette Notice No. 2326.
Key Evidence
A critical piece of evidence was a forensic examination of Hassan's Samsung phone, which contained three videos with extremist propaganda associated with al-Shabaab. The court determined these materials could be used to recruit and radicalize youth.
Magistrate Kiage noted, "In the absence of any reasonable explanation for their possession, the court infers the accused was associated with a terrorist group."
Prosecution's Case
The prosecution team, led by Kennedy Amwayi and supported by Fatuma Ahmed, presented testimony from ten witnesses. Their evidence met the required standard to convict Hassan on all seven counts, including three counts of collecting information and three counts of possessing terrorist-related articles.
The matter will return to court on July 29, 2026, for mitigation and sentencing.
