Three former security personnel, previously charged in connection with an international cybercrime investigation involving the United States Federal Bureau of Investigation (FBI), have been released following the withdrawal of their case by the Office of the Director of Public Prosecutions (ODPP).
The charges against Patrick Nyambaka Osoi, Jackson Kuria, and Hiram Kimanthi were dropped during a hearing at the Kahawa Law Courts. Principal Magistrate Gideon Kiage approved the prosecution's oral application to withdraw the case under Article 157 of the Constitution, and the defence did not oppose the move.
Magistrate Kiage ordered that the accused be discharged and set free. The case, registered as Criminal Case No. E104 of 2025, stemmed from investigations into an alleged transnational cybercrime syndicate reportedly targeting American organizations through business email compromise and other fraudulent online activities.
The suspects were arrested in 2025 as part of a broader probe involving Kenyan authorities and the FBI into cybercriminal networks operating from Kenya. Despite the withdrawal of charges, the discharge does not constitute an acquittal, and the possibility of fresh charges remains depending on future evidence.
