Civil society group Vocal Africa has issued a formal demand to the Mombasa County Government to stop ongoing construction at Treasury Square Garden, a public recreational space in the city.
The organisation alleges that the redevelopment project, which includes building a mosque within the garden, is proceeding without required public consultation, environmental impact assessments, or planning approvals.
Concerns Over Legal Compliance
- Public Participation: Vocal Africa states no public meetings or stakeholder forums were held before construction began, violating constitutional principles that mandate citizen involvement in decisions affecting public land.
- Environmental Approvals: The group highlights the absence of an Environmental Impact Assessment (EIA) and necessary licenses from the National Environment Management Authority (NEMA).
- Land Use Change: Converting the garden into a place of worship constitutes a change in land use, which requires legal approval and public consent, none of which have been provided.
After confirming construction activities through a site visit prompted by public complaints, Vocal Africa sent a demand letter giving the county government three days to halt work and seven days to provide documentation evidencing compliance with legal requirements.
The organisation has warned that failure to meet these demands will result in court action.
Awaiting County Response
As of now, Mombasa County officials have not issued a public statement addressing the allegations or the demand to suspend the project.
Vocal Africa is also calling for the removal of construction equipment and restoration of the garden pending completion of the proper legal procedures.
